Terms of Service

Fun Center Pro is a SaaS platform intended primarily for family entertainment centers and similar businesses. These Terms apply to anyone who accesses, creates an account for, subscribes to, or uses the platform and related services.

These Terms govern access to and use of:

• FunCenterPro.app
• the Fun Center Pro SaaS platform
• administrative tools
• booking functionality
• customer-management functionality
• messaging functionality
• AI-assisted features
• integrations
• other Fun Center Pro services

By accessing, creating an account, subscribing to, or using Fun Center Pro, the user agrees to these Terms. If the user does not agree, they should not use the service.

The person creating or administering a business account represents that they have authority to act on behalf of that business where applicable.

Fun Center Pro is intended primarily for businesses and authorized business users. Users must provide accurate account information and must have authority to use the service on behalf of any business they represent.

Users are responsible for:

• maintaining accurate account information
• keeping credentials secure
• maintaining appropriate permissions for their staff
• activity performed through their account
• promptly addressing suspected unauthorized access

Fun Center Pro may suspend access where reasonably necessary to protect the platform, customers, or users.

These Terms distinguish between businesses that subscribe to or operate Fun Center Pro, and consumers or end customers who make bookings or interact with those businesses.

The business using Fun Center Pro is generally responsible for its own services, event policies, pricing, refunds, cancellations, waivers, taxes, customer communications, and fulfillment of booked services. Fun Center Pro provides software and technology infrastructure and is not the operator of each entertainment venue.

Certain Fun Center Pro features may require a paid subscription. Plans may differ by:

• number of locations
• number of users
• integrations
• advanced reporting
• messaging usage
• AI usage
• other feature entitlements

Subscription pricing and included features may be presented during sign-up, checkout, account administration, or in separate pricing materials. A separate Subscription & Billing Policy may provide additional billing details.

Paid subscriptions may renew automatically at the applicable billing interval unless canceled according to the applicable subscription terms. Users authorize the applicable payment method to be charged for fees due.

This section covers reasonable matters such as failed payments, retry attempts, suspension for unpaid amounts, taxes where applicable, plan changes, upgrades and downgrades. More specific rules may appear in the Subscription & Billing Policy.

Fun Center Pro may integrate with third-party payment processors such as Stripe and Square. Businesses using Fun Center Pro may use those services to collect payments from their own customers.

Clarifications:

• payment processing may be subject to third-party terms
• Fun Center Pro does not control the payment networks
• chargebacks, processor holds, disputes, or processor outages can occur
• the business using FCP remains responsible for its own refund and customer-service obligations except where otherwise agreed

Fun Center Pro is not a bank, money transmitter, or payment processor.

Fun Center Pro may provide email and SMS functionality allowing businesses to communicate with customers. Businesses using Fun Center Pro are responsible for ensuring that their communications comply with applicable laws, including consent requirements.

Users must not:

• send unsolicited messages
• purchase or upload unlawfully obtained contact lists
• circumvent opt-outs
• send prohibited or abusive content
• misrepresent sender identity

Recipients may opt out of applicable SMS messages by replying STOP where supported. A dedicated SMS Terms page may also apply.

Users may not use Fun Center Pro for:

• unlawful activity
• fraud
• harassment
• spam
• phishing
• malicious software
• unauthorized access
• security attacks
• infringement of intellectual property
• abusive or deceptive communications
• attempting to interfere with platform availability

A separate Acceptable Use Policy may provide additional details.

Businesses retain responsibility for the information, content, customer records, templates, images, policies, and other material they place into Fun Center Pro.Fun Center Pro receives only the rights reasonably necessary to host, process, transmit, back up, and display that content in order to operate the service.

Fun Center Pro does not claim ownership of tenant or customer content. Customers must have the necessary rights and permissions to upload or use the content they provide.

Fun Center Pro and its software, interface, branding, underlying technology, documentation, and related materials are protected by intellectual-property laws. Users receive a limited right to use the platform according to these Terms.

Users may not:

• copy or redistribute the software
• reverse engineer where prohibited by law
• resell access without authorization
• remove ownership notices
• use Fun Center Pro trademarks without permission

Fun Center Pro may provide AI-assisted features such as:

• writing suggestions
• campaign suggestions
• summaries
• recommended actions
• automation recommendations
• review-response assistance
• other generated content

Important points about AI output:

• AI outputs may be inaccurate, incomplete, or inappropriate
• users are responsible for reviewing AI-generated output before using or sending it
• AI output should not be treated as professional legal, financial, medical, or other regulated advice
• Fun Center Pro may change or discontinue AI functionality

Fun Center Pro does not guarantee output accuracy.

Fun Center Pro may integrate with third-party services such as:

• Stripe
• Square
• Twilio
• Smartwaiver
• Google services
• AI providers
• other providers

Third-party products are governed by their own terms and policies. Fun Center Pro is not responsible for third-party service availability, changes, outages, or actions outside Fun Center Pro's reasonable control. Not every integration is available on every plan.

Some functionality may be labeled:

• beta
• preview
• early access
• unreleased
• experimental

Such features may:

• change
• contain errors
• have limited support
• be removed
• never become generally available

Users should not rely on unreleased functionality for critical operations unless explicitly authorized.

Fun Center Pro may:

• add or remove functionality
• update the interface
• perform maintenance
• modify integrations
• improve security
• make reasonable changes to the service

Fun Center Pro does not promise 100% uptime.

Fun Center Pro may suspend or terminate access where reasonably necessary because of:

• nonpayment
• material violation of these Terms
• unlawful use
• security threats
• fraud
• abuse
• risks to other users or the platform

Users may stop using the service and may cancel subscriptions according to applicable billing and cancellation policies.

Data may be retained for a reasonable period after account closure for purposes such as:

• legal obligations
• accounting records
• fraud prevention
• dispute resolution
• backups
• security purposes

The service is provided on an "as available" basis to the extent permitted by law.Fun Center Pro does not guarantee uninterrupted operation, error-free service, specific business results, increased bookings, increased revenue, AI accuracy, or third-party integrations.

To the extent permitted by law, Fun Center Pro's liability is limited for indirect, incidental, special, consequential, or lost-profit damages. A specific contractual liability cap may be added later if formally decided.

Businesses using Fun Center Pro are responsible for claims arising from their own services, content, unlawful use of Fun Center Pro, communications, violation of third-party rights, and violation of applicable law.

Because Fun Center Pro's formal business and legal structure has not yet been finalized, governing-law and dispute-resolution provisions may be supplemented or updated as that structure is finalized. No mandatory arbitration or class-action waiver is included at this time.

Fun Center Pro may update these Terms periodically. The Last Updated date shown near the top of this page will be revised when changes are made. Material changes may be communicated through the platform or other reasonable means when appropriate.

If one provision of these Terms is found unenforceable, the remaining provisions remain effective to the extent permitted by law.

These Terms, together with referenced policies and applicable subscription or order terms, form the agreement governing use of Fun Center Pro.
